This study does not bode well for failure to diagnose cancer cases. Jurors may believe the outcome of the disease is always the same despite early treatment in the best of hands. At the very least this attitude should be a subject addressed during voir dire, e.g. "How many people feel that if you get cancer you are most likely going to die no matter how early the diagnosis is made and how good the treatment?" Jurors who hold such attitudes can never be fair in a cancer case and must be excluded for cause.
